Police, Prosecutors, Judges Relying on a Proven Faulty Roadside Drug Test

As reported by ProPublica – common roadside drug test routinely used in many municipalities in the USA are returning false positives – which has been and continues to result in people being sent to jail either as a result of sentencing or plea-bargains. The knowledge that the tests are prone to significantly flawed results is known to the law enforcement who continue to use them.

Unfortunately it’s been found after the fact 74 percent of the convicted didn’t possess any drugs at the time of their arrest.

If we’d end the drug war – how many lives could we avoid destroying. Isn’t the idea of our justice system that we’d rather accidentally have one guilty person set free, than unjustly have one innocent person jailed?

How are we not holding those responsible for using such tests knowing they provided false positives – form the manufacturer, to the agencies that use them, to the courts that uphold their judgement in the face of invalidated results?

What a valuable reminder – never yield your 4th Amendment right and never consent to a car search no matter how innocent you are.

And a final thought –  possibly our local law enforcement policies should again be more about serving and protecting, rather than revenue generation, arrests, and convictions. It’s our responsibility to work with our public servants to make this society one we can all be safe in and proud of.
